2. Nature of the Platform
Tribe tinnitus operates an information and research platform available across: www.tribe-tinnitus.com and www.hear.help.
The platform currently provides:
- AI chat - available free of charge, without registration, on hear.help Provides general educational information only. Does not constitute medical advice, diagnosis, or treatment.
- Research report subscriptions - paid access to Weekly Report and Monthly Report, delivered via email. Detailed subscription terms are set out in the General Terms and Conditions of Sale (GTC), available at: www.tribe-tinnitus.com/OWS.pdf
All health-related content on our platforms is for informational and educational purposes only. Always consult a qualified healthcare professional regarding your condition and treatment decisions.
3. User Eligibility
The AI chat is accessible without registration and is available to all users. To purchase a subscription, you must be at least 18 years old and legally capable of entering into agreements in your jurisdiction.
4. Subscriptions, Payments, and Cancellation
Subscriptions are billed monthly at a flat rate. Payments are processed by Stripe, Inc. under its own terms and privacy policy.
Right of withdrawal: by completing a subscription purchase, you expressly request immediate delivery of the digital service and acknowledge that you lose the right of withdrawal under Art. 38(1) of the EU Consumer Rights Directive (2011/83/EU) once service delivery has commenced.
Cancellation: you may cancel your subscription at any time. Cancellation takes effect immediately - you will not receive the next report after cancellation. No partial refunds are issued for the current billing period.

5. AI Chat - Terms of Use
The AI chat feature is provided free of charge and without registration. By using it, you acknowledge that:
- responses are informational and educational only and do not constitute medical advice
- the chat does not replace consultation with a qualified healthcare professional
- chat interaction data may be stored for up to 24 months in accordance with our Privacy Policy
- you must not submit sensitive personal data, third-party confidential information, or content that violates applicable law
6. Prohibited Use
You agree not to:
- scrape, crawl, index, or harvest data from the platform
- bypass technical protections or security measures
- use the AI chat to generate content intended to mislead, harm, or deceive others
- use the platform for unsolicited marketing or spam
- attempt to reverse-engineer or interfere with the platform's functionality
7. Intellectual Property
All content published on the platform - including research reports, AI chat outputs, texts, and graphics - is the property of Tribe tinnitus Sp. z o.o. or its licensors. Reports purchased under a subscription are for personal use only and may not be redistributed, resold, or published without prior written consent.
8. Third-Party Services
The platform uses third-party components including payment processing (Stripe, Inc.) and AI chat infrastructure. We are not responsible for the availability, accuracy, accessibility, or data processing practices of third-party services. Use of these components is subject to the respective third-party terms and privacy policies.
9. Disclaimer of Warranties
The platform is provided "as is" and "as available". We do not guarantee uninterrupted operation, accuracy or completeness of AI chat responses, availability of specific report topics, or compatibility with all devices or browsers.
10. Limitation of Liability
To the maximum extent permitted by law, Tribe tinnitus Sp. z o.o. is not liable for any direct, indirect, incidental, or consequential damages arising from use of the platform, reliance on AI chat responses or report content, health or treatment decisions made on the basis of platform content, or technical disruptions or data loss.
11. Indemnification
You agree to indemnify and hold harmless Tribe tinnitus Sp. z o.o. from any claims, losses, or liabilities resulting from your use of the platform in violation of these Terms or applicable law.
12. Changes to the Platform
We may modify, update, suspend, or discontinue any part of the platform at any time without prior notice, including the scope of the AI chat feature or report subscription products.
13. Dispute Resolution
In case of any dispute, contact us first at the address provided in Section 1. We respond within 10 business days.
- EU users: you may use the EU Online Dispute Resolution platform: ec.europa.eu/odr
- Poland: mediation and ADR bodies recognised under Polish consumer law
- USA/Canada: disputes governed by Polish law, with jurisdiction of courts in Warsaw, unless mandatory consumer protection laws of your state or province provide otherwise
14. Governing Law
These Terms are governed by the laws of Poland and the European Union, supplemented by mandatory consumer protection rules in your country of residence.
15. Updates to These Terms
We may update these Terms at any time. The latest version is always available on each of our websites. Continued use of the platform constitutes acceptance of the latest version. Updates to the General Terms and Conditions of Sale (GTC) do not constitute an update of these Terms of Use, unless expressly stated otherwise.
